ARTICLE 1 - PREAMBLE

In accordance with the provisions of Articles 6-III and 19 of the French Law No. 2004-575 of June 21, 2004 for confidence in the digital economy ("LCEN"), this legal notice is brought to the attention of users and visitors of websites and the mobile application published by KRISTAL.

This legal notice applies, save for indication to the contrary, to all websites of the KRISTAL group:

ARTICLE 5 - ACTIVITY - DESCRIPTION OF THE SERVICE

The website kristalair.kristal.aero is the web companion of the KRISTAL.air mobile application, a free application for private pilots, providing community functions, organization of aviation competitions (KRISTAL CUP, TDP - Tour de Piste, ANR - Air Navigation Race, and other formats), flight sharing, and feedback. The KRISTAL.air application is an information and community tool. It is neither a certified navigation system nor an EFB. The pilot user remains solely responsible for the conduct of the flight as pilot in command (see KRISTAL.air T&Cs). KRISTAL does not sell any paid service to users from this website and does not receive any direct remuneration from users: the service is financed by sponsoring of third-party brands.

ARTICLE 6 - CONDITIONS OF ACCESS

6.1 Access to websites and the application is free of charge, subject to specific provisions applicable to restricted areas (in particular Customer Account, professional area), which may be subject to prior registration.

6.2 The space parts.kristal.aero is reserved to professional aviation customers. Registration requires the communication of professional identification elements (SIREN number or equivalent, intra-Community VAT number, applicable approvals). KRISTAL reserves the right to refuse or suspend any registration that does not meet these criteria.

6.3 The user is solely responsible for the equipment and connection allowing access to the websites and application.

ARTICLE 7 - INTELLECTUAL PROPERTY - TRADEMARKS

7.1 All content present on the websites and application - texts, images, graphics, logos, icons, photos, videos, sounds, trademarks, structures, code, database - is protected by applicable intellectual property laws, in particular the French Intellectual Property Code. Save for indication to the contrary, they are the exclusive property of KRISTAL AERONAUTIQUE or used under license.

7.2 The verbal and figurative trademark "KRISTAL AIR FOR THE FLYING COMMUNITY" is registered with the French INPI under filing number dated June 15, 2021, valid until June 15, 2031, in classes 9, 35, 38, 39, 41 and 45.

7.3 Any reproduction, representation, modification, distribution, transmission, translation, adaptation, in whole or in part, by any means and on any medium, is prohibited without prior written authorization from KRISTAL, save for exceptions provided by law (in particular short citations for critical, polemical, educational, scientific, or informational purposes).

7.4 Any unauthorized use is likely to constitute infringement within the meaning of Articles L335-2 et seq. of the French Intellectual Property Code, engaging the civil and criminal liability of its author.

7.5 User content (KRISTAL.air): content posted by users on the KRISTAL.air application remains their property. By posting, the user grants KRISTAL a non-exclusive license to host, distribute, and adapt (technically), in the conditions of the KRISTAL.air T&Cs.

ARTICLE 8 - PERSONAL DATA

8.1 KRISTAL processes personal data collected in compliance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act of January 6, 1978, as amended.

8.2 The precise modalities of processing (purposes, legal bases, recipients, processors, transfers outside the EU, retention periods, rights of data subjects, modalities of exercise of rights) are described in the Personal Data Protection Policy available on KRISTAL websites.

8.4 The user has the right to lodge a complaint with the CNIL (French Data Protection Authority - 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07 - www.cnil.fr) in case of persistent disagreement.

ARTICLE 9 - COOKIES AND TRACKERS

9.1 KRISTAL websites use cookies and trackers strictly necessary for service operation, as well as audience measurement and personalization cookies subject to user consent.

9.2 The detailed Cookie Policy is accessible from the footer of each website. The user may at any time configure choices via the dedicated banner or via the "Cookie Preferences" page.

ARTICLE 10 - HYPERLINKS - THIRD-PARTY CONTENT

10.1 KRISTAL websites may contain links to third-party websites (manufacturers, authorities, partners, media, etc.). KRISTAL has no control over these third-party websites and assumes no liability for their content, availability, or compliance.

10.2 The creation of hyperlinks pointing to KRISTAL websites is subject to prior authorization, save for links for non-commercial information purposes and respecting the image and reputation of KRISTAL.

10.3 Integrated third-party content (videos, maps, sharing plug-ins, etc.) remains subject to the conditions and policies of their respective publishers.

ARTICLE 11 - EDITORIAL LIABILITY

11.1 KRISTAL takes care to ensure the accuracy and updating of information broadcast on its websites and application. However, KRISTAL cannot be held responsible for errors, omissions, inaccuracies, or update failures, whether of its own making or of partner third parties.

11.2 The information broadcast is provided for indicative purposes. It does not constitute technical advice, legal advice, or contractual commitment, save for express mention to the contrary or conclusion of a specific contract with KRISTAL.

11.3 KRISTAL shall not be liable for direct or indirect damages resulting from access to, use of, or inability to use the websites or application, nor for damages resulting from the consultation of information appearing thereon.

11.4 KRISTAL does not warrant continuous or uninterrupted availability of the websites and application, which may be suspended for maintenance, update, or in case of force majeure.

11.5 KRISTAL.air - informational tool not a substitute: the KRISTAL.air application is an information and community tool for private pilots. It is not a certified navigation system, nor an EFB (Electronic Flight Bag) within the meaning of EASA AMC, nor a substitute for the official preparation of the flight. The pilot remains solely responsible for the conduct and safety of the flight as pilot in command. No route, performance, data, or community content broadcast via the application may be construed as a flight plan, recommendation, or technical advice from KRISTAL.

ARTICLE 12 - REPORTING OF ILLEGAL CONTENT

12.1 In accordance with Article 6-I-5 of the LCEN and Article 16 of Regulation (EU) 2022/2065 of the European Parliament and the Council of October 19, 2022 ("DSA"), any user may report to KRISTAL content it considers manifestly illegal (in particular on the KRISTAL.air application, likely to host user content).

12.2 Reporting procedure: the report must be addressed by email to signalement@kristal.aero or via the dedicated form of the application, and specify:

Precise identification of the content (URL, identifier, screenshot where applicable);
The reason why the content is considered illegal, with reference to applicable legal provisions;
The contact details of the reporting party (save for cases authorizing anonymity);
A good-faith declaration on the accuracy of the report.

12.3 KRISTAL acknowledges receipt of the report and examines it as soon as possible. KRISTAL acts as a host within the meaning of Article 6-I-2 of the LCEN with regard to user content, and has no general obligation to monitor content, without prejudice to its obligations to remove any manifestly illegal content notified in accordance with Article 6-I-5 LCEN.

12.4 Any abusive, inaccurate, or bad-faith report may engage the civil and criminal liability of its author (Art. 6-I-4 LCEN).

12.5 As a small enterprise within the meaning of Article 19 of the DSA (workforce below 50 persons and turnover below 10 million euros), KRISTAL benefits from the corresponding exemptions from obligations applicable to larger platforms.

ARTICLE 13 - MEDIATION AND DISPUTE RESOLUTION

13.1 In accordance with Articles L611-1 et seq. of the French Consumer Code, the consumer, in case of dispute with KRISTAL not resolved by a prior claim addressed to contact@kristal.aero, may resort to a consumer mediator free of charge.

13.2 The consumer may also resort to the Online Dispute Resolution (ODR) platform of the European Commission, accessible at: https://ec.europa.eu/consumers/odr.

ARTICLE 14 - GOVERNING LAW - JURISDICTION

14.1 This legal notice and the use of KRISTAL websites and applications are governed by French law.

14.2 Any dispute relating to the use of websites and applications, that could not be resolved amicably or by recourse to consumer mediation where applicable, shall be submitted to the competent French courts.

14.3 For professional users, jurisdiction is granted to the courts of the registered office of KRISTAL AERONAUTIQUE (Tribunal de commerce de Montpellier), in accordance with the applicable General Terms and Conditions of Sale.

14.4 For consumer users, jurisdiction is granted to the courts territorially competent in application of the French Code of Civil Procedure, without prejudice to more favorable rules to the consumer resulting from European Union law.

ARTICLE 15 - MODIFICATION OF THE LEGAL NOTICE

KRISTAL reserves the right to modify this legal notice to take account of any legal, regulatory, jurisprudential, technical, or organizational evolution. The version in force is the one published as at the date of consultation.
